According to authorities the incident took place on the evening of May 8th in San Ysidro as a family was returning home from Disneyland; they were only blocks away from their home when a pickup truck collided with their car. Border Patrol agents came upon the crash at the intersection of Camino De La Plaza and Dairy Mart Road around 11:30 p.m. Saturday evening. They found multiple victims and called local authorities. The suspect later identified by authorities as Constantino Banda-Acosta, 38, a Mexican national who according to Boarder Patrol has been deported 15 times since 2002. ICE officials were cited as stating that 15 removals is a “significant number” indicating an “egregious immigration violation”. San Diego police arrested Banda-Acosta, who was suspected of driving under the influence and leaving a crash scene with injured people.

The 6-year old was identified as Lennox Lake by a relative suffered intense hear trauma and underwent a surgery, according to his relative. The boy’s parents suffered minor injuries from the crash. Doctors say they are cautiously optimistic that the boy will make a full recovery.

“Right now, he has a lot of swelling and can’t open either of his eyes so he’s scared about why he can’t see,” his father Ben Lake told reporters while holding back tears. “I just really care about bringing him home and making sure he’s happy again.”

The family may be eligible to receive assistance from President Trump’s new executive order for the Victims of Immigration Crime Engagement (VOICE), an office created to help victims of crimes committed by undocumented immigrants. In addition to government assistance the family also started a GoFundMe site to help alleviate the costs of medical bills.
